This privacy policy (“Privacy Policy”) from Sidekick Concierge Inc., a Delaware corporation (“Sidekick Concierge”, “we”, “us”, or “our”), discloses information regarding the collection, use, and disclosure of information that you submit to Sidekick Concierge or that Sidekick Concierge collects about you while using Sidekick Concierge’s services or software (the “Service and Software”) through any of Sidekick Concierge’s related websites and/or mobile applications (collectively, the “Site”). Through the Site, we connect certain individuals seeking to obtain certain services (“Members”) to independent contractors seeking to provide such services (“Sidekicks”).

User Consent

By using Sidekick Concierge’s Service and Software (including Sidekick Concierge’s website or mobile application), you hereby warrant and represent that you have read, understand and agree to all terms and conditions stated and in Sidekick Concierge’s Terms of Service. This Privacy Policy may change from time to time with or without notice, so please check Sidekick Concierge’s website regularly to see any updates to this Privacy Policy. If, at any time, you no longer agree with the terms of this Privacy Policy, please cease any further use of the Service and Software. Continued use of the Service and Software indicates your reading, understanding, and acceptance of any revised terms in this Privacy Policy.

Children and Individuals Under the Age of 18

The Service and Software are not meant for individuals under the age of 18, and the Service and Software may use mechanisms to prevent the registration and use of the Service and Software by such underage individuals. In the event that Sidekick Concierge discovers it has collected personal information from a child under the age of 18 without parental consent, Sidekick Concierge will delete that personal information as soon as possible.

Information Sidekick Concierge Collects

Sidekick Concierge collects the personal information that you submit when registering and using the Service and Software, including, but not limited to, items such as your name, delivery address, e-mail address, account name and password, phone number, credit card or other payment information, and other information that you enter into Sidekick Concierge’s systems.

Sidekick Concierge may collect anonymous information through cookies, navigational data such as Uniform Resource Locators (URL), and other technologies for tracking users. A cookie is a small piece of data containing a unique identification number that is sent to your browser from a Web server, and is stored on your computer or other device’s hard drive. The unique ID number identifies your browser to Sidekick Concierge whenever you visit. Cookies do not enable anyone to access personally identifiable information that you have not already given us. Cookies and other data allow Sidekick Concierge to track your usage of the Service and Software, including the date and time of visits and the items viewed or searched. Sidekick Concierge may collect information about the computer you are using, such as what internet browser you use, the kind of computer you use, and other information about how you use the Site

If you use a mobile device to access the Service and Software, Sidekick Concierge may also collect additional information from your mobile device, such as unique device identification numbers or geo-location information. Uses of Collected Information

Sidekick Concierge uses the personal information collected from you to fulfill your service requests made through the Service and Software. This involves actions such as providing your service request, delivery address, and phone number to independent contractors involved in fulfilling your transactions, providing your credit card or other payment information to third-party payment processors, and using information from independent contractors to perform background checks or other types of screening, which may involve the assistance of third parties. Sidekick Concierge attempts to keep such personal information secure by using security methods customary for such types of transactions. Sidekick Concierge also uses information collected from you to customize your use of the Service and the Software as well as to improve the Service and the Software by performing quality reviews and similar activities. For example, such information may be used: to process your orders and service requests; to track your preferences and present you with promotions that may be of interest; to track overall traffic and usage to expand and optimize the Service and the Software; to store and allow you to track your previous orders; to implement any referral or rewards program for new customers, independent contractors, or business partners; or to diagnose and fix bugs or service problems in the Service or Software. In using your information in such ways, your information may be transmitted to servers located inside or outside the United States, among employees and contractors working for Sidekick Concierge, or to third parties as described in this Privacy Policy. Sidekick Concierge may also use the personal information collected from you to (i) create De-identified information such as aggregate statistics relating to the use of the Service; (ii) notify you when Site updates are available; (iii) market and promote our Site and Services offered to you through the Site; (iv) fulfill any other purpose for which you provide us personal information; and (v) for any other purpose for which you give us authorization. Disclosure of Collected Information

Sidekick Concierge may share aggregated information that includes non-identifying information and log data with third parties for industry analysis, demographic profiling and to deliver targeted advertising about other products and services. Sidekick Concierge may employ third party companies and individuals to facilitate or improve the Service and Software, to provide the Service and Software on its behalf, to process payment, provide customer support, provide geo-location and other information to Sidekicks to host its job application form, to perform website-related services (e.g., without limitation, maintenance services, database management, web analytics, and improvement of the Service and Software’s features), or to assist Sidekick Concierge in analyzing how the Service and Software are used. These third parties have access to your personal information only to perform these tasks on Sidekick Concierge’s behalf and are obligated not to disclose or use it for any other purpose other than the purpose for which we disclose it to them. Sidekick Concierge may also provide personal information to Sidekick Concierge’s business partners or other trusted entities for the purpose of providing you with information on goods or services Sidekick Concierge  believes will be of interest to you. If you choose to purchase any of these goods or services, your personal information such as delivery address or payment information may be used to complete such transactions. You can, at any time, opt out of receiving such communications through a mechanism indicated in such communications.

Sidekick Concierge cooperates with government and law enforcement officials and private parties to enforce and comply with the law. Sidekick Concierge will disclose any information about you to government or law enforcement officials or private parties as Sidekick Concierge, in its sole discretion, believes necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Sidekick Concierge, a user of the Service and Software, or a third party, to protect the safety of the public or any person, or to prevent or stop activity Sidekick Concierge considers to be, or to have the potential to be, illegal, unethical, or legally actionable. In addition, Sidekick Concierge may disclose information about you to counter or prevent any malicious access or use of the Service and Software or to prevent harm or loss to any user of the Service and Software. Sidekick Concierge may provide personal information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Sidekick Concierge’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information maintained by the Site is among the assets transferred.

Links and Third Party Websites

Sidekick Concierge’s website or Software may contain links to other websites owned and operated by third parties. Sidekick Concierge is not responsible for the privacy practices or the content of such other websites. Sidekick Concierge expressly disclaims any liability that may arise from your use or provision of any of your information whatsoever to third-party websites.

Retention and Update Policy

To preserve the integrity of its databases, Sidekick Concierge may retain collected information for an indefinite length of time. If required by law, as is the case to comply with the Children’s Online Privacy Protection Act (COPPA), Sidekick Concierge will delete information from its database when it receives an appropriate request. If you wish to make such a request, which requires that Sidekick Concierge verify your identity, or if you have any questions regarding this policy, please contact Sidekick Concierge using the contact information in the section “California Privacy Rights” in this Privacy Policy. You agree not to hold Sidekick Concierge liable for responding in good faith to any request that appears to come from a legitimate source for that type of request. If you wish to update any of your personal information or your privacy or marketing settings, you may use the mechanisms provided on Sidekick Concierge’s website or the Software or contact us at privacy@sidekickconcierge.com. By using any portion of the Service and Software, you hereby represent and warrant that you understand and agree that all content and information submitted by you to Sidekick Concierge by any means becomes the property of Sidekick Concierge (or if such property rights are not transferable to Sidekick Concierge by applicable law, you agree to grant Sidekick Concierge an irrevocable, worldwide, perpetual, royalty-free, transferable license to use such information in any manner) and may be used in the sole discretion of Sidekick Concierge in accordance with this Privacy Policy and the Terms of Use.

Security

Sidekick Concierge uses security measures to protect the loss, misuse, and alteration of the information under its control. For example, we use encryption protocols for sensitive information such as credit card or payment information. Such measures may change from time to time, depending on industry standards and perceived security risks. However, despite such security measures, Sidekick Concierge cannot guarantee the security of your information and disclaims liability for loss, misuse, and alteration of your information under its control to the maximum extent permitted under applicable law. By using the Service and Software, you agree to assume any security risk related to personal information.
